Conditions to employ foreign personnel in home services
Due to the increasing number of applications made at the Ministry for work permits to employ foreign personnel in household services in recent years, it has been decided that the following limitations should be introduced to prevent the abuse of this issue and protect the security of foreigners holding a permit.
- Except for those aimed at elderly care, patient care or child care, it will not be allowed to employ foreigners in households.
- It is imperative that the existence of a medical condition requiring care is proven by a medical certificate.
- Except for situations requiring serious care, no work permit will be issued for male foreigners to work in households.
Wage: For foreigners to be employed in home services, the gross wage to be paid shall be at least the minimum wage, taking into account the minimum wage applicable as of the date of application. (2.558,40 TL).
The work permit application can be made by the employer in 2 ways according to following conditions:
- Application for foreigners holding a residence permit:
If the foreigner has a residence permit of at least 6 months or more (except for student residence permits), the application for foreign staff work permit can be made directly to the Ministry.
After the work permit is approved, the foreigner may start his/her legal employment once the social security and address registration is performed.
- Abroad (employment visa) application:
Application for foreigners who do not have a residence permit for at least 6 months must be made at the Turkish Consulates located in the foreigner’s home country.
After the work permit is approved, the foreigner may enter Turkey once the employment visa is processed into the foreigner’s passport. The foreigner may start working after the social security and address registration is performed.
Action to be taken after approval of work permit
Subsequent to approval of the work permit (or in case of applications made abroad, subsequent to the foreigner entering Turkey with an employment visa), the foreigner must be immediately enrolled into social security and an address registration must be made at the relevant Registry Office within 20 days.
- Social security registration:After having obtained the work permit, the foreigner must be enrolled into social security.
For this, the employer has to apply to the relevant SSI Provincial Directorate to register the residential workplace and initiate the insurance of the foreign person.
To seek information about the premium to be paid over the gross wage (at least 2.558,40 TL) declared at the application phase, please call the ALO 170 hotline to contact the Insurance Directorate which your home address is affiliated to. Further details about the actions to be taken for social security registration will be made available by Mioseta after approval of work permit.
Please make sure that the foreigner’s insurance premiums are paid in timely and uninterrupted manner.
If, during applications made to extend a work permit, it is found that social insurance premiums have not been paid in full or not been paid at all, no extension will be granted. In this case, criminal proceedings may be initiated by SSI against the employer for employing uninsured workers.
- Address registration: Subsequent to approval of the work permit (or in case of applications made abroad, subsequent to the foreigner entering Turkey with an employment visa), an address registration must be made within 20 days.
For address registration, apply with the foreigner to the Registry Office, which the foreigner’s intended work address is affiliated to. For application purposes, it will suffice to bring the work permit card, the foreigner’s passport, and a document (rental contract, invoice etc.) as proof of address.
Illicit foreigners: Illicit foreigners in Turkey need to pay administrative fines and leave the country before they become eligible to apply for a work permit. For this, it is sufficient to apply to the Visa Infringement Department at the airport on the day of departure together with a boarding pass and passport. Administrative fines may vary according to the foreigner’s home country and the length of the foreigner’s illicit stay in Turkey.
